Can dosage instructions become a health claim?

Yes. In Vista-Life Pharma, C-721/24, the Court held that frequency or method of administration can be a health claim when the way of taking a supplement is presented as linked to a health benefit or to avoiding an adverse effect.

DIRECT ANSWER

The link to a health effect is the deciding feature.

“Take one capsule daily” is a practical instruction by itself. “Daily is better than one large dose” or “sublingual use improves absorption” suggests a benefit from the administration method and needs health-claim review. The Court did not create a blanket rule that every dosage instruction is a claim.

Administration can imply a product–health relationship.

The dispute included “daily better than single dose” and a sublingual route said to provide faster absorption and avoid degradation. The Court read “claim” broadly enough to include a manner of consumption presented as relevant to the product’s characteristics.
